Commissioner Thaell moved, seconded by Commissioner Sauls, to approve Option #1: Conduct the first and only public hearing and deny the proposed Ordinance, retaining the existing R-3 (Single Family Detached, Attached Two Family Residential) District, based on the findings of fact and conclusions of law of the Tallahassee-Leon County Planning Commission. Commissioner Winchester presented an overview of the issue and displayed drawings of the area. Planning Director Tedder explained that Option #1 is the recommendation of the Planning Commission and Planning staff has recommended Option #2. He explained that the difference is the Planning Commission deals with policy and Planning Department deals with facts. Commissioner Sauls withdrew her second and Commissioner Rackleff then seconded the motion. Commissioner Winchester offered a substitute motion, seconded by Commissioner DePuy, to approve Option #2: Conduct the first and only public hearing and revise the proposed Ordinance to amend the Official Zoning Map from the R-3 (Single Family Detached, Attached Two Family Residential) to the OS (Open Space) district for the southernmost 50 ft. of the parcel, and to the M-1 (Light Industrial) district for the remainder of the parcel. (Staff recommendation). Speakers: Mr. Elvin Kever, spoke on behalf of the residents on Autumn Woods Way and stated that they support the Planning Commission’s recommendation to deny the rezoning. Mr. Bruce Benson, a resident on Autumn Woods Way, also requested the Board approve the Planning Commission’s recommendation. Mr. Tedder explained that the applicant did not apply for the required permit and violated stop work orders. Note! it was recorded at least 3 times stop work orders were Violated. There was considerable Board discussion regarding the rezoning and the applicant’s failure to follow the law. On the final vote by Commissioners: Commissioner DePuy withdrew his second. Commissioner Grippa offered a second. The substitute motion failed 2-5, with Commissioners DePuy, Proctor, Rackleff, Sauls, and Thaell opposed. The original motion passed 5-2, with Commissioners Grippa and Winchester opposed. The 20 the residents on Autumn Woods Way that showed up for this meeting left in a very good mode. Being assured that the 100 ft buffer zone would be rebuilt to in sure the quality of life resumes as it was before and once and forall remain that way. Lawson Electric bulldosed is way thru the neighborhood. And also promised that there would be a noise ordnance in place shortly. Date January 24th 2006 |
| Progress Report: On the Reclaimation of the Violated buffer zone! Dead Line March 9th 2006 March 9th was date set by Leon County Commissioners office for Mr. Lawson to have is site returned to a buffer Zone. Nobody of AUTUMN WOODS WAY TALLAHASSEE FLORIDA has seen this happen to date: May 21th 2006. Autumn Woods people heard that a fine of $250.00 a day for Lawsons Failure to respond to the orders of the Leon county commissioners office to return this R3 land back to the buffer zone.
· This Find should get his attention but for some reason it has not should up as so.
· We wonder what the heck is going on here.
Autumn Woods Way Leon County Florida resident's feel his twenty Plus truck Fleet parked and driven in this R3 Zone daily should be impounded and a local impound yard. We Feel this because of his is refusing to clean up as ordered and is still using this land illegaly.
After all they are Illegally parked in a residential Buffer Zone that for sure must be a Motor Violation of some sort.
Since it is well know Lawson has no intentions of going by the rulings of the Leon Commissioners meeting Jan 24th 2006. |

Commissioner Dan Winchester Support passing this rezone effort even after hearing all the continued on slot of violations committed by the new property owner(Lawson Electric) After a Leon County Stop Work order Had been activated on the R3 and exsiting M1 area. It was noted at this meeting Public Meeting January 24,2006 6:00PM Commissioner Dan Winchester had visited this site several times and failed to enforce the stop work order for the People of Leon County! The area in dispute was totally abused by Lawson Electric Lawless effort to rush into and clear cut what ever please him. |
